Jay Fabian, who has served as the NASCAR’s Cup Series Managing Director since 2019, is currently facing two felony counts and one misdemeanor count of animal cruelty, according to court records in North Carolina.
Fabian has a court date set for September 27, 2021.
NASCAR released a statement Wednesday, confirming that it was aware of the charges and that Fabian would be stepping away from his role with the sport while he handled the matter in the legal system.
“NASCAR takes the situation seriously, and will continue to gather information as it becomes available. Jay Fabian will step back from his role until this matter is resolved. NASCAR will have no further comment,” the statement read.
Section 14-360 (A) of North Carolina Law states, “Cruelty to animals; construction of section. (a) If any person shall intentionally overdrive, overload, wound, injure, torment, kill, or deprive of necessary sustenance, or cause or procure to be overdriven, overloaded, wounded, injured, tormented, killed, or deprived of necessary sustenance, any animal, every such offender shall for every such offense be guilty of a Class 1 misdemeanor.”
Section 14-630 (B) states, “If any person shall maliciously torture, mutilate, maim, cruelly beat, disfigure, poison, or kill, or cause or procure to be tortured, mutilated, maimed, cruelly beaten, disfigured, poisoned, or killed, any animal, every such offender shall for every such offense be guilty of a Class H felony. However, nothing in this section shall be construed to increase the penalty for cockfighting provided for in G.S. 14-362.”
UPDATE: Information obtained from the Charlotte-Mecklenburg Police Department indicates that three dogs were seized from Fabian. One of those dogs was “deceased.” Another dog was listed in a police report as “almost deceased” and a third dog was listed as “healthiest dog.”
The incident report narrative states, “On 07-21-2021 at approximately 1500 hours, CMPD received a 911 call regarding an animal cruelty case located at 11024 Hunters Trace Lane in Charlotte. The investigation is ongoing at this time.”
It appears the value of each dog was listed at $500 under the “seized” category of the report.
The officer making the report was Officer Anna Maas, who is a K9 officer with the CMPD. She has been in that role for six years, according to her LinkedIn profile. Prior to that, she worked with the Greensboro Police Department. She is a graduate of N.C. State University with a Bachelor of Arts in Criminology and was a Division 1 athlete. She also interned for the U.S. Attorney’s Office and the U.S. Marshall’s Service.
